In our opinion, the Criminal Proceeds (Recovery) Act 2009 has not always been used effectively by defence barristers in the past decade or so. If you are told by a lawyer there is nothing you can do until a forfeiture hearing, that is not correct. Criminal proceeds litigation is civil litigation. It is about property. It is about assets. You need barristers and solicitors who have experience in private law with the particular types of assets, and asset arrangements, the police have seized, restrained, and seek to forfeit from you. Barristers with experience in commercial law, property, trusts, company law, and with a good awareness of public law are preferable. |
